The BUYER further acknowledges, declares, and undertakes that, before the conclusion of the distance sales agreement, they have accurately and completely obtained the address, the main characteristics of the products ordered, the prices of the products including taxes, and the payment and delivery information that the SELLER is required to provide.
9.2. Each product subject to this Agreement shall be delivered to the BUYER or to the person and/or organization designated by the BUYER at the address specified by the BUYER, within the period stated in the preliminary information on the Website, depending on the distance of the BUYER’s place of residence, provided that such period does not exceed the statutory period of 30 days.
If the product cannot be delivered to the BUYER within this period, the BUYER reserves the right to terminate the Agreement.
9.3. The SELLER accepts, declares, and undertakes to deliver the product subject to the Agreement complete, in accordance with the specifications stated in the order and, where applicable, together with warranty certificates, user manuals, and any information and documents required for the proper use of the product.
The SELLER shall perform its obligations in accordance with applicable legal requirements and standards, in good faith and with due care, maintain and improve the quality of its services, and act with the necessary care, prudence, and foresight during the performance of its obligations.
9.4. If necessary, the SELLER may supply a different product of equal quality and price, provided that the BUYER is informed and gives their express consent before the performance period of the contractual obligation expires.
9.5. If performance of the order becomes impossible and the SELLER is therefore unable to fulfill its contractual obligations, the SELLER agrees, declares, and undertakes to notify the consumer in writing within 3 days from the date it becomes aware of such impossibility and to refund the total amount to the BUYER within 14 days.
*9.6. The BUYER acknowledges, declares, and undertakes that they will electronically confirm this Agreement for the delivery of the product. If the price of the product subject to the Agreement is not paid for any reason and/or the payment is cancelled in the bank records, the SELLER’s obligation to deliver the product shall cease.
9.7. If, after delivery of the product to the BUYER or to the person and/or organization designated by the BUYER, the product price is not paid to the SELLER by the relevant bank or financial institution due to unauthorized or fraudulent use of the BUYER’s credit card, the BUYER agrees, declares, and undertakes to return the product to the SELLER within 3 days, with the shipping costs borne by the SELLER.
9.8. If the SELLER is unable to deliver the product within the agreed period due to force majeure or other circumstances beyond the reasonable control of the PARTIES that are unforeseeable and prevent and/or delay the fulfillment of their obligations, the SELLER agrees, declares, and undertakes to notify the BUYER.
In such circumstances, the BUYER shall have the right to request cancellation of the order, replacement of the product with an equivalent product where available, and/or postponement of delivery until the circumstances preventing delivery have ceased.
If the BUYER cancels the order, payments made in cash shall be refunded in full and in cash within 14 days.
For payments made by credit card, the product price shall be refunded to the relevant bank within 14 days following the cancellation of the order by the BUYER.
The BUYER acknowledges that it may take approximately 2–3 weeks for the refunded amount to be reflected in the BUYER’s account by the bank, depending entirely on the bank’s processing procedures, and that the SELLER shall not be held responsible for any delays arising from such banking procedures.
9.9. The SELLER shall have the right to contact the BUYER through the address, email address, landline and mobile telephone numbers, and other contact details provided by the BUYER during registration on the Website or subsequently updated by the BUYER, by means including letters, email, SMS, telephone calls, and other communication methods, for communication, marketing, notification, and other purposes.
By accepting this Agreement, the BUYER acknowledges and declares that the SELLER may carry out the communication activities described above.
9.10. Before accepting delivery of the goods/services, the BUYER shall inspect them and shall not accept any product that is visibly damaged or defective, including products that are dented, broken, or have torn or damaged packaging.
Acceptance of the delivery shall be deemed confirmation that the goods/services were received in good and undamaged condition.
After delivery, the BUYER is responsible for taking reasonable care of the goods/services.
If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned.
9.11. If the person placing the order is different from the holder of the credit card used for the order, or if a security concern relating to the credit card used for the order is identified before delivery, the SELLER may request the BUYER to provide identification and contact information of the cardholder, a statement for the previous month relating to the credit card used for the order, or a written document from the cardholder’s bank confirming that the credit card belongs to the cardholder.
The order may be placed on hold until the requested information/documents are provided. If the requested information or documents are not provided within 24 hours, the SELLER shall have the right to cancel the order.
9.12. The BUYER declares and undertakes that all personal and other information provided while registering on the SELLER’s Website is accurate and truthful and agrees to immediately compensate the SELLER, in full and in cash, for any damages incurred by the SELLER due to inaccurate or false information, upon the SELLER’s first notification.
9.13. The BUYER agrees and undertakes in advance to comply with all applicable laws and regulations when using the SELLER’s Website and not to violate them.
Otherwise, all resulting civil and criminal liabilities shall be borne solely and exclusively by the BUYER.
9.14. The BUYER may not use the SELLER’s Website in any manner that disrupts public order, violates public morality, disturbs or harasses others, serves an unlawful purpose, or infringes the material or moral rights of others.
The BUYER may also not engage in activities that prevent or make it difficult for other members to use the services, including spam, viruses, Trojan horses, or similar activities.
9.15. The SELLER’s Website may contain links to other websites and/or content owned and/or operated by third parties that are not under the SELLER’s control.
Such links are provided solely for the convenience of the BUYER and do not constitute an endorsement of any linked website or its operator, nor do they constitute any warranty regarding the information contained on such websites.
9.16. Any member who violates one or more provisions of this Agreement shall be personally liable for any civil and criminal consequences arising from such violation and shall indemnify and hold the SELLER harmless from the legal and criminal consequences of such violation.
In addition, if the matter is referred to legal authorities as a result of such violation, the SELLER reserves the right to seek compensation from the member for breach of the membership agreement.
ARTICLE 10 – RIGHT OF WITHDRAWAL
10.1. In distance contracts concerning the sale of goods, the BUYER may exercise the right of withdrawal within **14 (fourteen) days** from the date on which the product is delivered to the BUYER or to the person/organization designated by the BUYER, by notifying the SELLER, without assuming any civil or criminal liability and without providing any reason.
For distance contracts concerning the provision of services, this period begins on the date the contract is concluded.
The right of withdrawal cannot be exercised for service contracts where performance has commenced with the consumer’s consent before the withdrawal period has expired.
The costs arising from the exercise of the right of withdrawal shall be borne by the SELLER.
By accepting this Agreement, the BUYER acknowledges in advance that they have been informed about their right of withdrawal.
10.2. To exercise the right of withdrawal, the BUYER must notify the SELLER in writing within the 14-day period by registered mail, fax, or email, and the product must not have been used, subject to the provisions regarding “Products for Which the Right of Withdrawal Cannot Be Exercised.”
If the right of withdrawal is exercised:
a)The invoice for the product delivered to the third party or the BUYER must be returned.
If the invoice was issued to a company or other legal entity, the return must be accompanied by a return invoice issued by that entity. Returns of orders invoiced to companies cannot be completed unless a RETURN INVOICE is provided.
b) The return form must be provided.
c) The products being returned must be delivered complete and undamaged together with their original box, packaging, and standard accessories, if any.
d) The SELLER is obliged to refund the total amount and any documents creating a payment obligation for the BUYER within no later than 10 days following receipt of the withdrawal notification and to take back the goods within 20 days.
e) If the value of the goods decreases or the return becomes impossible due to a reason attributable to the BUYER, the BUYER shall compensate the SELLER for the resulting damages in proportion to their fault.
However, the BUYER shall not be responsible for changes or deterioration resulting from the proper use of the goods or product during the withdrawal period.
f) If exercising the right of withdrawal causes the order to fall below the minimum amount required for a promotional campaign offered by the SELLER, the discount received under that campaign shall be cancelled.
ARTICLE 11 – PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal cannot be exercised, in accordance with the applicable Regulation, for products prepared according to the BUYER’s request or clearly personal needs and unsuitable for return; certain intimate apparel products; swimwear; bikini bottoms; cosmetics; disposable products; goods that may rapidly deteriorate or expire; products that are unsuitable for return for health or hygiene reasons where their packaging has been opened after delivery; goods that, after delivery, become mixed with other products and cannot be separated due to their nature; newspapers and magazines and other periodicals, except where supplied under a subscription agreement; services performed instantly in an electronic environment; intangible goods delivered instantly to the consumer; and audio or video recordings, books, digital content, software programs, data-recording and data-storage devices, and computer consumables where their protective packaging has been opened by the BUYER.
The right of withdrawal also cannot be exercised for services whose performance has commenced with the consumer’s consent before the withdrawal period has expired.
Cosmetics and personal care products, intimate apparel, swimwear, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and tapes, and stationery consumables such as toner, cartridges, and ribbons may only be returned if their packaging has not been opened and the products have not been tested, damaged, or used.
ARTICLE 12 – DEFAULT AND LEGAL CONSEQUENCES
If the BUYER defaults on a payment made by credit card, the BUYER acknowledges, declares, and undertakes that they will be responsible for paying interest and fulfilling their obligations to the card-issuing bank in accordance with the credit card agreement between the BUYER and the bank.
In such circumstances, the relevant bank may initiate legal proceedings and may request reimbursement from the BUYER for any resulting costs and attorney’s fees.
In all cases, if the BUYER defaults on their payment obligations, the BUYER agrees to compensate the SELLER for any damages and losses incurred by the SELLER as a result of the delayed performance of the BUYER’s payment obligations.
ARTICLE 13 – COMPETENT AUTHORITIES AND DISPUTE RESOLUTION
Complaints and objections arising from this Agreement shall be submitted, within the applicable monetary limits specified under the relevant legislation, to the Consumer Arbitration Committee or Consumer Court located at the BUYER’s place of residence or at the place where the consumer transaction was carried out.
Under Article 68 of Law No. 6502 on Consumer Protection, a monetary threshold applies to applications made to Consumer Arbitration Committees, and disputes exceeding the applicable threshold cannot be submitted to such committees.
The applicable monetary threshold is published annually in the Official Gazette.
For 2026, the monetary threshold for applications to Provincial/District Consumer Arbitration Committees was increased by 25.49%, from TRY 149,000 to TRY 186,000, effective as of 1 January 2026.
Accordingly, for consumer applications made in 2026, disputes concerning goods or services with a value below TRY 186,000 (one hundred eighty-six thousand Turkish lira) may be submitted to the relevant Provincial or District Consumer Arbitration Committee together with the relevant information and supporting documents.
This Agreement is concluded for commercial purposes.
ARTICLE 14 – EFFECTIVE DATE
